Excluded or estranged relatives

Testamentary trusts

Optional. Trusts set up inside the will to receive a beneficiary's share. Most clients haven't heard of these — if you'd like us to explain at the appointment, just pick "Not sure / need advice" below.

What is a testamentary trust? Instead of leaving a share directly to a beneficiary, the will sets up a trust for them. The benefits: income to children is taxed at adult rates (significant saving for minor beneficiaries), the trust assets are protected from creditors and family-law claims against the beneficiary, and the trustee has flexibility over how income and capital are distributed. The downside: more complexity and ongoing trustee duties. Often used when a beneficiary has significant income, business exposure, divorce risk, or special needs.
